ABOUT THIS PRIVACY STATEMENT
1. Vision Intelligence Limited is committed to protecting personal information and complying with the New Zealand Privacy Act 2020.

2. This Privacy Statement explains how Vision Intelligence Limited collects, uses, stores, discloses and protects personal information in connection with:
           (a) use of our New Zealand website;
           (b) enquiries submitted to us through our website or other contact channels;
           (c) customer and prospective customer relationship management; and
           (d) marketing communications.

3. In this Privacy Statement:       
           (a) “personal information” means information about an identifiable individual; and
           (b) “we”, “us” and “our” refer to Vision Intelligence Limited.

4. This Privacy Statement is intended to apply to website and marketing contact information only. It does not apply to surveillance, monitoring, CCTV, alarm, access-control or other operational data that we may process or store on behalf of customers in connection with the services we provide. Those matters are addressed separately in our customer contracts, terms of service or other applicable service documentation.

SCOPE
5. This Privacy Statement applies only to personal information collected by Vision Intelligence Limited in connection with our New Zealand website, enquiries, customer and prospective customer relationship management, and marketing communications.

6. It replaces previous public-facing New Zealand website privacy statements from the effective date stated above, to the extent those statements relate to website and marketing contact information.

7. This Privacy Statement does not apply to business operations data, including surveillance, CCTV, alarm, monitoring, access-control, incident response or other operational data processed or stored by Vision Intelligence Limited on behalf of customers. Those matters are addressed separately in our customer contracts, terms of service or other applicable service documentation.

PERSONAL INFORMATION WE COLLECT
8. Vision Intelligence Limited will only collect personal information by lawful and fair means. We collect personal information only where it is lawful, fair and reasonably necessary for our functions or activities relating to our website, enquiries, customer relationship management and marketing communications.

9. Where practicable, we take reasonable steps to ensure individuals are aware that their personal information is being collected, the purpose of collection, the intended recipients of the information, whether collection is authorised or required by law, and the consequences if the information is not provided.

10. The types of personal information we may collect in connection with our website, enquiries and marketing activities include:
           (a) your name;
           (b) your business or organisation name;
           (c) your job title or role;
           (d) your email address;
           (e) your telephone number;
            (f) your postal or business address;
           (g) information you provide when you complete a website form, make an enquiry, subscribe to communications, request information or contact us;
           (h) records of our communications with you;
            (i) your marketing preferences, including whether you have opted in or unsubscribed from communications;
            (j) customer relationship management information, such as notes about enquiries, preferences, services of interest and previous interactions; and
           (k) website and technical information, such as IP address, device information, browser type, operating system, referring website, pages viewed, time spent on pages and cookie or analytics information.

11. We do not seek to collect surveillance, CCTV, alarm, access-control or operational monitoring data through this website privacy statement.

12. Sensitive Information: We do not generally seek to collect information that is sensitive in nature through our website, enquiry or marketing processes. If you provide information to us that is not reasonably necessary for these purposes, we may delete, de-identify or disregard that information where lawful and reasonable to do so.

13. We may collect personal information:
           (a) directly from you, including when you:
                   (i) use our website;
                  (ii) complete an online form;
                 (iii) contact us by email, telephone or through our website;
                 (iv) subscribe to marketing communications;
                  (v) request information about our products or services; or
                 (vi) communicate with our sales, marketing or customer relationship teams;
           (b) from your organisation, where your organisation provides your contact details to us for business communication purposes;
           (c) from publicly available sources, such as company websites, business directories or public registers;
           (d) from third-party platforms or service providers used for marketing, analytics, contact management or customer relationship management; and
           (e) automatically through our website, including through cookies, analytics tools and similar technologies.

14. Where practicable, we collect personal information directly from the individual concerned. Where we collect personal information from another source, we will do so only where permitted by the Privacy Act 2020 or another applicable law.

15. If we receive unsolicited personal information, we will determine whether we could have lawfully collected that information. If not, and if it is lawful and reasonable to do so, we will destroy or permanently de-identify it.

USE AND DISCLOSURE

Vision Intelligence Limited uses personal information collected in connection with our website, enquiries and marketing activities for the purposes for which it was collected, for directly related purposes, for purposes authorised by you, and for other purposes permitted by the Privacy Act 2020 or another applicable law.

17. We may use personal information collected in connection with our website, enquiries and marketing activities for the following purposes:
           (a) to respond to enquiries, requests and communications;
           (b) to provide information about our products and services;
           (c) to manage customer and prospective customer relationships;
           (d) to maintain and update our customer relationship management and marketing contact records;
           (e) to send marketing, promotional, event, product, service or business update communications, where permitted by law;
            (f) to understand interest in our products and services;
           (g) to manage subscriptions, unsubscribe requests and marketing preferences;
           (h) to operate, maintain, secure and improve our website;
            (i) to analyse website traffic, website usage and the effectiveness of marketing activities;
            (j) to improve our communications, website content, products and services;
           (k) to comply with legal, regulatory and compliance obligations;
            (l) to detect, investigate or prevent spam, misuse of our website, security incidents or unlawful activity; and
          (m) for any other purpose authorised by you or permitted by law.

DISCLOSURE OF PERSONAL INFORMATION
18. We may disclose personal information collected in connection with our website, enquiries and marketing activities where reasonably necessary for the purposes described in this Privacy Statement.

19. We link our marketing contact information with HubSpot, our customer relationship management provider, for customer relationship management, analytics and email distribution purposes.

20. We may also disclose personal information:
           (a) to our officers, employees, contractors and authorised representatives, where required for website, enquiry, customer relationship management or marketing purposes;
           (b) to Google Analytics, in relation to website analytics information as described in the cookies and analytics section below;
           (c) to professional advisers, including lawyers, accountants, auditors, insurers and consultants, where reasonably required;
           (d) to regulators, government agencies, law enforcement agencies, courts or tribunals, where required or permitted by law;
           (e) in connection with a proposed or actual business sale, restructure, merger, acquisition, financing arrangement or transfer of assets; and
            (f) to any other person or organisation authorised by you or permitted by law.

21. Other than as described above, we do not share website or marketing contact information with other third-party platforms or service providers.

22. We do not sell personal information.

OVERSEAS DISCLOSURE AND STORAGE
23. We may store or process website and marketing contact information using cloud-based systems or service providers located outside New Zealand.

24. In particular:
            (a) marketing contact information may be stored or processed through HubSpot, which we use for customer relationship management, analytics and email distribution purposes; and
            (b) website analytics information may be processed through Google Analytics.

25. Before disclosing personal information to an overseas recipient, we will take reasonable steps to ensure that the recipient is required to protect the information in a way that, overall, provides comparable safeguards to those in the Privacy Act 2020, unless an exception under the Act applies.

MARKETING COMMUNICATIONS
26. We may use your contact details to send you information about our products, services, updates, events or other matters that may be of interest to you or your organisation, where permitted by law.

27. All marketing emails sent by us include an unsubscribe function. We record and action unsubscribe requests.

28. You may opt out of receiving marketing communications at any time by:
           (a) using the unsubscribe function in the relevant communication; or
           (b) contacting us using the details in section 47 below.

29. We will send commercial electronic messages in accordance with the Unsolicited Electronic Messages Act 2007.

COOKIES, ANALYTICS AND WEBSITE INFORMATION
30. When you use our website, we may collect technical information about your visit, including:
           (a) IP address;
           (b) browser type;
           (c) device type;
           (d) operating system;
           (e) pages viewed;
            (f) time spent on pages;
           (g) links clicked;
           (h) referring website or source; and
            (i) general website usage information.

We use cookies and similar technologies to operate our website and understand how visitors use it.

31. We use Google Analytics to collect and analyse website usage information. Google Analytics helps us understand matters such as how visitors arrive at our website, which pages are viewed, how long visitors spend on the website, and how the website can be improved.

32. We do not use Meta Pixel, LinkedIn Insight Tag, heat-mapping tools, session replay tools or other advertising or tracking technologies for the purposes of this Privacy Statement.

33. You may disable cookies through your browser settings. However, some website features may not operate properly if cookies are disabled.

DATA QUALITY AND SECURITY
34. Accuracy: We take reasonable steps to ensure that the personal information we hold is accurate, up to date, complete, relevant and not misleading before using or disclosing it.

35. You may contact us if you believe that personal information we hold about you is inaccurate, incomplete or out of date.

36. Security: We take reasonable steps to protect personal information from loss, unauthorised access, use, modification, disclosure or other misuse.

37. These steps may include physical, technical and organisational safeguards, such as access controls, secure systems, authentication measures, monitoring, confidentiality obligations and secure storage.

38. No method of transmission or storage is completely secure. However, we will take reasonable steps appropriate to the nature of the information and the risks associated with its handling.

39. Retention: We retain website and marketing contact information only for as long as it is required for the purposes for which it was collected, or as otherwise required or permitted by law.

40. For example, we may retain personal information while:
           (a) we have an ongoing business relationship with you or your organisation;
           (b) we are responding to an enquiry or request;
           (c) you remain subscribed to marketing communications;
           (d) retention is required for legal, regulatory, compliance, audit, insurance or dispute resolution purposes; or
           (e) retention is reasonably required for legitimate business administration purposes.

41. When personal information is no longer required, we will take reasonable steps to securely destroy it or permanently de-identify it.

ACCESS AND CORRECTION
42. Under the Privacy Act 2020, you have the right to request access to the personal information we hold about you. You also have the right to request a correction if you believe the information is inaccurate. Requests should be directed to us using the contact details in section 10 below.

43. We may need to verify your identity before responding to a request. We will respond to access and correction requests in accordance with the Privacy Act 2020.

44. If we refuse a request, or do not make a requested correction, we will explain the reason where required by law. You may ask us to attach a statement of correction to the information.

PRIVACY BREACHES
45. If we become aware of a privacy breach involving personal information covered by this Privacy Statement, we will assess and respond to it in accordance with the Privacy Act 2020.

46. Where a privacy breach has caused, or is likely to cause, serious harm, we will notify the Office of the Privacy Commissioner and affected individuals, unless an exception applies.
